Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the SoilStudio website, mobile application, app features, content, support channels, and related services. SoilStudio is provided by SoilStudio LLC (“SoilStudio,” “we,” “us,” or “our”).

By accessing or using SoilStudio, you agree to these Terms. If you do not agree, do not use SoilStudio.

1. Product status

SoilStudio is a garden care, plant tracking, soil insight, weather-aware planning, learning, and related mobile app experience. Some features may be in development, beta testing, TestFlight testing, preview, or limited release.

Features, availability, supported platforms, app tiers, product descriptions, screenshots, pricing, and launch timing may change as development and testing continue.

2. Informational guidance only

SoilStudio may provide plant care, plant identification, plant health, pest, soil, watering, weather, garden planning, product, and related information. SoilStudio is provided for general informational and educational purposes only.

SoilStudio is not a substitute for professional agricultural, horticultural, environmental, engineering, chemical, pest control, medical, legal, financial, or safety advice. You are responsible for evaluating guidance before acting on it.

For serious plant disease, pesticide use, structural property issues, drainage issues, erosion, hazardous plants, toxic plants, edible plant safety, mushroom identification, animal safety, or other high-risk situations, consult a qualified professional, local extension office, product label, or other authoritative source.

3. AI-assisted and photo-based features

Some SoilStudio features may use automation, image analysis, artificial intelligence, or other software-based methods to generate suggestions, summaries, identifications, or guidance.

AI-assisted and photo-based outputs may be incomplete, inaccurate, or not appropriate for your specific plant, soil, climate, property, or situation. SoilStudio does not guarantee that any identification, diagnosis, care plan, weather interpretation, product suggestion, or other output is correct.

You should use your own judgment and verify important decisions before taking action.

4. Gardening and outdoor risk

Gardening involves changing conditions and practical risks, including weather, pests, tools, chemicals, fertilizers, pesticides, irrigation, soil conditions, slopes, water features, wildlife, pets, and edible plants.

You are responsible for using SoilStudio safely and for following applicable laws, product labels, safety instructions, local regulations, and professional guidance.

5. User content

SoilStudio may allow you to submit, upload, store, or create content, including plant records, garden notes, photos, messages, prompts, care tasks, locations, journal entries, voice notes, and feedback (“User Content”).

You retain ownership of your User Content. By using SoilStudio, you grant SoilStudio a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, analyze, transmit, display, and use your User Content as needed to operate, provide, support, secure, maintain, and improve SoilStudio.

You represent that you have the rights needed to submit your User Content and that your User Content does not violate the law or the rights of others.

Do not submit content that is unlawful, harmful, infringing, misleading, invasive of privacy, or otherwise inappropriate for SoilStudio.

6. Feedback

If you provide ideas, suggestions, bug reports, comments, or other feedback, you agree that SoilStudio may use that feedback without restriction or compensation to you.

7. Accounts, local use, and device responsibility

Some SoilStudio features may be available without creating an account, and some data may be stored locally on your device. Other features may require cloud processing, app permissions, subscription access, or service provider support.

You are responsible for maintaining access to your device, protecting your device, managing backups where available, and understanding that deleting the app, clearing app data, changing devices, or disabling permissions may affect your access to some information or features.

8. Subscriptions and paid features

SoilStudio may offer free and paid features, including subscription-based features such as Pro access.

If you purchase a subscription or other digital product through the App Store, the purchase is processed by Apple and is subject to Apple’s payment, renewal, cancellation, and refund terms. Subscription pricing, duration, renewal details, and trial terms will be shown at the time of purchase.

Subscriptions may renew automatically unless canceled through your Apple account settings before the renewal date. SoilStudio does not control Apple’s payment processing, refund decisions, or App Store account settings.

We may change free or paid features, app tiers, subscription benefits, pricing, or availability over time, subject to applicable law and App Store requirements.

9. Shop, product links, and affiliate disclosure

SoilStudio may display or link to third-party products, retailers, tools, supplies, seeds, irrigation products, or other garden-related items.

Some links may be paid or affiliate links. This means SoilStudio may earn a commission or other compensation if you purchase through those links.

Third-party retailers are responsible for their own products, prices, availability, descriptions, shipping, returns, warranties, customer service, terms, and privacy practices. SoilStudio is not responsible for third-party products or retailer experiences.

Product suggestions are informational and should not be treated as professional, safety, chemical, pesticide, or suitability advice.

10. Acceptable use

You agree not to:

• Misuse, disrupt, overload, damage, or interfere with SoilStudio.
• Attempt to gain unauthorized access to SoilStudio systems, accounts, data, or infrastructure.
• Reverse engineer, scrape, crawl, copy, or extract SoilStudio content or systems except where permitted by law.
• Submit unlawful, harmful, infringing, misleading, abusive, or privacy-invasive content.
• Use SoilStudio to violate applicable law or the rights of others.
• Circumvent usage limits, app tiers, security controls, or access restrictions.
• Use SoilStudio outputs to make high-risk decisions without appropriate verification.

11. Intellectual property

SoilStudio, including its name, logo, app design, website, text, graphics, icons, features, software, workflows, and related materials, is owned by SoilStudio LLC or its licensors and is protected by intellectual property and other laws.

These Terms do not grant you any ownership rights in SoilStudio. You may use SoilStudio only as permitted by these Terms and applicable app store rules.

12. Third-party services

SoilStudio may rely on third-party services for hosting, infrastructure, analytics, diagnostics, AI-assisted functionality, image analysis, weather context, app distribution, subscriptions, payments, communications, support, or product links.

Third-party services may be subject to their own terms and privacy policies. SoilStudio is not responsible for third-party services except as required by applicable law.

13. App Store terms

If you download SoilStudio through the Apple App Store, your use of the app is also subject to applicable Apple terms, including the Apple Media Services Terms and Apple’s standard Licensed Application End User License Agreement unless SoilStudio provides a custom license agreement through Apple.

14. Beta and testing features

If you use a beta, TestFlight, preview, or pre-release version of SoilStudio, you understand that the app may contain bugs, incomplete features, changing designs, inaccurate outputs, downtime, or data resets.

We may modify, suspend, remove, or reset beta features or data as part of testing and development.

15. Disclaimers

SoilStudio is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, SoilStudio disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that SoilStudio will be uninterrupted, error-free, secure, complete, accurate, or suitable for every garden, plant, soil condition, climate, property, or use case.

16. Limitation of liability

To the fullest extent permitted by law, SoilStudio LLC and its owners, employees, contractors, service providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, property damage, plant loss, crop loss, or other losses arising from or related to your use of SoilStudio.

To the fullest extent permitted by law, SoilStudio’s total liability for any claim arising from or related to SoilStudio will not exceed the amount you paid to SoilStudio for the service giving rise to the claim in the twelve months before the claim arose, or one hundred dollars, whichever is greater.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

17. Suspension or termination

We may suspend or terminate access to SoilStudio if we believe you violated these Terms, created risk or possible legal exposure, misused the service, or used SoilStudio in a way that could harm SoilStudio, users, service providers, or others.

You may stop using SoilStudio at any time.

18. Changes to SoilStudio

We may change, suspend, remove, limit, or discontinue any part of SoilStudio at any time. We may also update features, app tiers, usage limits, content, designs, and availability.

19. Changes to these Terms

We may update these Terms from time to time. Updates will be posted with a revised “Last updated” date. If changes are material, we may provide additional notice where appropriate. Your continued use of SoilStudio after updated Terms become effective means you accept the updated Terms.

20. Governing law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.
